Gentlemen:
As you are no doubt aware, the Carrier has begun promotion of all trainmen who have previously failed promotion, or passed up promotion, as outlined In Article V of PEB 219. The provisions of Side Letter #9 will govern the actual testing of the employees. Once notified, all employees must comply with instructions issued. The Carrier will cooperate in furnishing materials and assistance to aid in preparation for the exam. Should an employee fail the exam, such employee will be given up to three additional exams, as well as verbal coaching or other assistance that is deemed appropriate. In the event an employee cannot pass the conductor exam, he will continue to work, provided his retention does not result in utilization of an unnecessary employee; nor cause the creation or continuation of a reserve board position. Therefore, as long as a reserve board is continued, these employees will be furloughed. Upon successful passing of the conductors exam(s) all employees will be placed on the bottom of the conductors seniority roster in the same order as their brakeman ranking. Any post 1985 employees who do not have two years actual experience will be tested at a later date and will establish seniority based on their examination date.
