| Many think, or at least say, that the 7th Circuit ruled that railroads may
not substitute paid leave for unpaid FMLA leave. Actually, that isn't right.
Here's what the decision, which the Supreme Court has now left standing,
really holds: The court ruled that if the relevant collective bargaining agreements (CBA's) do not allow for substitution, railroads may not substitute | |
| But, the court also ruled that, if the CBA's do allow for substitution, then substitution is permitted | |
| The court said that, under the governing law (the federal Railway Labor Act (RLA)), only a RLA arbitrator can interpret the CBA's and decide for sure what they require. | |
| So, the court declined to decide what the CBA's require, whether
substitution is permitted or barred by any of the CBA's |
BNSF has already completed one such arbitration with TCU. You might be surprised, given some things being said lately, to find that the arbitrator determined that, under the BNSF - TCU CBA's, BNSF can properly require substitution of paid leave when taking FMLA leave. As for other BNSF scheduled people, no such arbitration case is pending.
In short, and most importantly, this all means that BNSF's FMLA policy
remains lawful, valid and in effect.

PROTECTING JOBS, SAFETY AND RAILROAD RETIREMENT
CLEVELAND, Jan. 30 -- Setting past differences aside, the Brotherhood of Locomotive Engineers and Trainmen (BLET) and the United Transportation Union (UTU) have agreed to work together on a joint campaign to ensure a successful outcome to the current round of collective bargaining.
During negotiations, the major rail carriers have attempted to use past differences between the BLET and the UTU as a wedge to reduce crew size. Reducing crew size puts the lives of all rail workers and the general public in danger. It also seriously threatens the financial security of the Railroad Retirement system.
BLET President Don M. Hahs and UTU President Paul C. Thompson announced the joint campaign in a letter dated Jan. 27, 2006.
"Our two organizations have had their differences, but when it comes to protecting our members' jobs and safety, we must stand together against the hostile attacks of the carriers' expressed intent on eliminating jobs," the Presidents said.

2. CLAIMS AND GRIEVANCE PROCEDURES
3. HOURS OF SERVICE LAW: ANOTHER NEGOTIATED ITEM.
4. HOLIDAY PAYMENTS: DID THESE JUST MATERIALIZE? NO. WON THROUGH NEGOTIATION.
5. MEDICAL INSURANCE
THESE ARE JUST A SAMPLE OF THE THINGS OUR UNION HAS DONE FOR US. GRANTED ALMOST
EVERYONE HAS THESE THINGS FROM THEIR EMPLOYERS, BUT IT WAS THE UNIONS THAT
FOUGHT THE BATTLES TO GAIN THESE BENEFITS. THE NON-UNION EMPLOYERS JUST FOLLOWED
SUIT. THINK ABOUT WHAT YOU SAY, WHEN YOU SAY, "THE UNION HAS DONE NOTHING FOR
US". THINK ABOUT WHAT THE GENERATION OF RAILROADERS BEFORE US FOUGHT FOR AND
ACHIEVED. JUST THINK ABOUT IT.....
